U.S. Attorney General Merrick Garland Briefs the Press on DOJ Lawsuit Challenging Idaho Abortion Law

The US Department of Justice filed a lawsuit on Tuesday seeking to block Idaho’s restrictive new abortion law on the grounds that it violates federal law requiring most hospitals to give patients medically necessary treatment. before releasing them.

Attorney General Merrick Garland is scheduled to hold a press conference Tuesday afternoon detailing the lawsuit.

The lawsuit filed in federal court in Idaho notes that the state “enacted a near-absolute ban on abortion,” which, after it went into effect Aug. 25 will make it a criminal offense to perform an abortion “in all but extremely limited circumstances”.

Garland said the ban conflicts with the federal Emergency Medical Treatment and Labor Act, which requires a hospital that accepts Medicare funds to provide treatment in its emergency departments to stabilize a patient needed to stabilize their state of health before transferring or discharging the patient.
